Attorney Vitalii Petryk helped cancel a court order on the collection of household waste removal debt

Attorney Vitalii Petryk successfully helped two citizens (the Clients) cancel a court order on the collection of debt for household waste removal services.

Essence of the case:

The company “Obukhivmiskvtorresursy” applied to the court to collect from the Clients a debt of UAH 12,619.82 for waste removal services for the period from 01.01.2021 to 31.12.2023, plus court costs of UAH 302.80. The court issued a court order for the debt.

The Clients’ position:

The Clients did not accept the company’s claims. They stated that they had never concluded any contract with the company for waste removal services and had never received any notices of the alleged debt.

The attorney’s actions:

Attorney Vitalii Petryk filed an application to cancel the court order. He pointed out that the company had provided the court with no evidence confirming the Clients’ debt.

Result:

Having considered the application, the court cancelled the court order. This means the Clients are not obliged to pay the alleged debt.
