Court cancelled a police protocol under Part 5 of Art. 126: attorney Vitalii Petryk!

The court cancelled an administrative offense resolution with the help of attorney Vitalii Petryk!

A driver accused of repeatedly driving without the right to drive was released from punishment thanks to the work of attorney Vitalii Petryk.

Essence of the case:

On July 8, 2023 the driver was charged with driving a vehicle without the right to do so, for the second time within a year. According to the protocol, he was driving a car on Bratyslavska St., 48-A in Kyiv.

The attorney’s position:

Attorney Vitalii Petryk, representing the driver in court, insisted on closing the case due to the absence of an administrative offense. He noted that the case file contained no evidence that the driver had committed any of the violations under Parts 2-4 of Article 126 within the year. Nor was there any evidence that the driver had been deprived of the right to drive.

Court decision:

The court, having examined the case and heard the parties’ arguments, ruled to close the administrative offense case due to the absence of both the event and the elements of an administrative offense.

Significance of this decision:

This decision is an important precedent, demonstrating that even in difficult situations qualified attorney assistance can help drivers avoid unjust punishment.

Recommendations for drivers:

  • Know your rights: Know the traffic rules and your rights and obligations as a driver.
  • Seek an attorney’s help: If you are accused of an administrative offense, contact a qualified attorney without delay.
