Defense under Art. 130 of the Code of Administrative Offenses

Protecting drivers’ rights in court: attorney Vitalii Petryk

In this article we review a court decision in a case under Art. 130 of the Code of Administrative Offenses, in which attorney Vitalii Petryk successfully defended a client accused of driving under the influence of alcohol.

A citizen of Moldova was stopped by police on suspicion of driving while intoxicated. He refused to take an alcohol test, so the police drew up a protocol under Part 1 of Art. 130.

This significantly violated his right to defense, as he could not understand the essence of the charge or his rights.

The court agreed with the attorney’s arguments and ruled to close the case due to the absence of an administrative offense.
