Attorney Vitalii Petryk successfully challenged an administrative offense protocol under Part 1 of Art. 130 of the Code of Administrative Offenses

In the Holosiivskyi District Court of Kyiv, attorney Vitalii Petryk successfully challenged an administrative offense protocol under Part 1 of Art. 130 (driving a vehicle while intoxicated).

The court established that the police officers had no grounds to demand a sobriety examination, as no signs of alcohol intoxication had been recorded in the driver.

On this basis the court closed the proceedings due to the absence of an administrative offense in the driver’s actions.

Importantly, in this case attorney Vitalii Petryk managed to prove the following:

  • The police officers had no lawful grounds to stop the vehicle.
  • The video recording attached to the protocol contained no evidence that the driver was intoxicated.
  • The driver did not refuse the sobriety examination, but was not given the opportunity to undergo it properly.
